This paper deals with k-sets in $S_{3,q}$ such that every plane meets them at either $(n-1)q+1$ or $nq+1$ points $(2\le n\le q)$. Thus, with suitable graphic conditions, we obtain a new characterization of the hyperbolic quadrics and of the hermitian varieties in $S_{3,q}$.
